The Federal District Court has accepted a criminal complaint filed by former president Jair Bolsonaro (PL) against hacker Walter Delgatti Neto for the crime of denunciation. With this, a criminal action will be initiated and Delgatti will become a defendant.
The complaint was made due to Delgatti’s testimony at the Joint Parliamentary Commission of Inquiry (CPMI) on January 8, in August last year. The hacker claimed that Bolsonaro had asked him to assume responsibility for a wiretap against Supreme Court Justice Alexandre de Moraes, something the former president’s defense denies. Delgatti’s defense has not yet commented on the decision.
Judge Omar Dantas Lima, of the 3rd Criminal Court of BrasÃlia, considered that Delgatti’s “proof of materiality” and “evidence of authorship” had been presented. The hacker has 10 days to present his defense.
Bolsonaro’s lawyers requested a harsher sentence for Delgatti because he made the statements in the “presence of numerous people”. The crime of slander provides for imprisonment from six months to two years, with an increase of one third if it occurs “in the presence of several people, or by means that facilitate the dissemination of the slander”, as well as payment of a fine.
In his testimony, Delgatti said that Bolsonaro had mentioned that he had obtained a “wiretap” from Moraes and that it was necessary for him to admit his authorship.
“According to him (Bolsonaro), they had obtained a wiretap, which was so expected at the time, from Minister Alexandre de Moraes. That would have compromising conversations of the minister, and he needed me to assume the authorship of that wiretap,” Delgatti said at the CPMI session, which took place on August 17.
“I was the Car Wash hacker, right. So it would be difficult for the left to question this authorship, because back then I would have taken over “Vaza-Jato”, which I was, and they supported. So the idea would be for a boy from the left to take over this wiretap,” he added.
