Judge Alan Ide Ribeiro da Silva, of the 2nd Criminal Court of Augustinópolis (Tocantins), decided to close the testimony of Rebeca Barbosa Oliveira after the defendant opened a beer during a virtual hearing. The case happened on Monday (6) and went viral on social media.
In the video, it is possible to see the judge outraged by the defendant’s action. “Doctors, doctors. Here’s the thing, doctors. I’m seeing that the defendant just cracked open a beer. It’s recorded here. Doctors, I’m not going to interrogate a person who’s drinking in an act, which is a serious act of judgment. So, I’m not going to interrogate her and I’m going to order that Rebeca be immediately excluded from the courtroom,” he said.
In addition to ending the testimony and excluding Rebeca from the room, the magistrate sentenced the woman to pay ten minimum wages (about R$ 14 thousand) for disrespecting the Judiciary.

The Rebeca case
was being tried for two crimes, insult and threat. After the incident, the magistrate heard other witnesses, the defendant’s defense and the prosecutor’s accusation.
Subsequently, Rebeca was acquitted of the crime of libel due to the absence of overwhelming evidence. However, the woman was sentenced to three months and two days in detention for the crime of threatening. She can appeal.
The
judge also convicted the woman of bad faith litigation, that is, of abusive, disloyal or corrupt conduct of one of the parties to a lawsuit.
“In view of the behavior of the defendant who during the investigation, who in turn opened a bottle of beer and began to ingest its contents, I CONDEMN her for litigation in bad faith […] in view of their risky (reckless) behavior in the procedural act. In compliance with the provisions of article 81, paragraph 2, of the Code of Civil Procedure, in the face of such disrespectful behavior, I set the sentence at 10 minimum wages,” reads the decision.
