The São Paulo Court of Justice won for Tiririca in an appeal filed by Roberto Carlos. The singer wanted the comedian to be prevented from maintaining the parody of the song ‘O Portão’, made in 2022 during the election period.
The two have been fighting in court since 2014, when the politician used the verses of “O gate” for the first time.
In the original song, the singer says “I’m back now to stay, because here, here is my place”, and the parody turned into “I voted, again I’m going to vote. Tiririca, Brasília is your place.”
The denied appeal concerns the 2022 process, because Tiririca also imitated Roberto Carlos arguing with a fan when he was running for the position of federal deputy.
In the lawsuit, the singer asked for compensation of R$ 50 thousand, in addition to requesting the immediate removal of the video, alleging the campaign made the public believe, erroneously, that the singer would vote for Tiririca, in addition to disturbing the artist’s image.
The comedian defended himself and pointed out that he was using freedom of expression and “did not have the purpose and effectively did not infringe any right of the plaintiff’s personality”.
In October 2023, the magistrate understood that the parody was clear to garner votes, it had no association with anything that would damage Roberto Carlos’ image. The singer filed an appeal and was denied in the second instance.
