Last Thursday (1st), civil police officers from the General Investigations Police Station carried out an operation in Itanhaém (SP) that resulted in the apprehension of a 17-year-old teenager and the arrest of a 47-year-old man. The action was motivated by an internal security report and focused on objects related to Nazism found in the young man’s residence.
During the execution of the search and seizure warrant, agents found two firearms, notebooks with notes, books by Adolf Hitler and two telephone devices in the teenager’s property.
In addition, the young man revealed to investigators that he intended to carry out an attack and maintained a social media account to disseminate Nazi, anti-Semitic and supremacist messages.
The 47-year-old man, who was also detained, is accused of involvement in the young man’s activities. The detailed information about the operation was kept confidential to avoid the “contagion effect”, that is, to prevent other young people from feeling inspired to adopt similar behaviors.
Crime
In Brazil, the possession of Nazi materials, the planning of attacks and the propagation of hate speech are serious crimes. Law No. 7,716/1989, known as the Caó Law, typifies propaganda and apology for Nazism, punishing with imprisonment from 1 to 3 years and a fine.
The planning of attacks can be classified as terrorism, according to Law No. 13,260/2016, with penalties ranging from 15 to 30 years, depending on the severity. Hate speech, especially on social networks, is punishable by imprisonment from 1 to 3 years and fines, according to the Brazilian Penal Code and Law No. 13,187/2015.
While for adults the penalties can include imprisonment and fines, 17-year-olds are judged according to the ECA (Statute of the Child and Adolescent).
Penalties for young people do not include imprisonment, but may involve socio-educational measures ranging from warnings and community service to hospitalization for up to 3 years, depending on the severity of the act.
